TOWN OF FRANKLIN INLAND WETLAND AND WATERCOURSES COMMISSION (IWWC) FRANKLIN TOWN HALL 7 Meetinghouse Hill Rd. Franklin, CT 06254 MEETING MINUTES July 14, 2010 7:30 p.m. 1. Call to Order: Chairman Weingart called the Meeting to order at 7:32 p.m. Members in Attendance: Chairman Herman Weingart, Vice Chair Don Smith, Secretary Leo Bienvenue Members Absent: Calli Carboni, Joseph LeVasseur Alternate Members Present: Niels Jeppesen, John Kochiss Alternate Members Absent: Tammi Avery Also Present: Mr. Thomas Weber, Franklin Wetlands Officer Chairman Weingart seated Mr. Jeppesen for Mr. LeVasseur and Mr. Kochiss for Ms. 2. Recognition of Visitors: Town of Franklin Town Attorney Mr. Ron Ochsner, and Richard DeSchamps of Preston. No general public members were present. 3. Public Hearing: Chairman Weingart opened the Public Hearing at 7:35 p.m. and read the public hearing notice into the record. a. (7:35 p.m.) Proposed amendments to the “Inland Wetland and Watercourses Regulations” for the Town of Franklin in order to bring them into compliance with the Inland Wetland and Watercourses Model Municipal Regulations written by the State of Connecticut Department of Environmental Protection: Mr. Richard Serra, SECOG, has worked with the Commission over several meetings to review potential revisions to the Regulations in conjunction with municipal regulations written by the State of Connecticut Department Environmental Protection. Additionally, Attorney Ochsner comprehensively reviewed the regulations from a legal, landuse standpoint and provided the Commission with an amended copy dated July 14, 2010 as the latest draft. The Commission held review of the draft regulations page by page in reference to highlighted areas including amended information provided by Attorney Ochsner. There was IWWC consensus to continue the public hearing to their regular meeting of Wednesday, August 11, 2010, 7:30 p.m., for further review, comments and potential conclusion and adoption. 4. Additions to the Agenda: none 5. Report of the Wetlands Officer: Mr. Weber noted he has attended a Federal Emergency Management Association (FEMA) seminar. There was discussion on the management of flood plains, how to best manage disasters; permit requirements, and how to compile data reports for substantial problems. Mr. Weber also noted FEMA regulations should be incorporated into local town regulations. 6. Approval of Minutes: a. June 9, 2010 IWWC MINUTES: 7-14-10 2 MOTION made by Mr. Bienvenue, SECONDED BY Mr. Smith, That the Inland Wetland and Watercourses Commission approve the Meeting Minutes of June 9, 2010, as amended: Ø Agenda Item #8 b.: clarification: change “is” to renew / to “plans” to renew VOICE VOTE: UNANIMOUS; MOTION CARRIES 7. Unfinished Business: a. Proposed amendments to the “Inland Wetland and Watercourses Regulations” for the Town of Franklin in order to bring them into compliance with the Inland Wetland and Watercourses Model Municipal Regulations written by the State of Connecticut Department of Environmental Protection MOTION made by Mr. Jepessen, SECONDED BY Mr. Smith, That the Inland Wetland and Watercourses Commission continue the Public Hearing to the IWWC Regular Meeting of Wednesday, August 11, 2010, 7:30 p.m. at the Franklin Town Hall. VOICE VOTE: UNANIMOUS; MOTION CARRIES 8. New Business: a. Application #10-04, J.D. Thakral & Associates, property located at 25 Murphy Road Franklin, CT. Assessors Map 44 – 10, proposed construction of a 3,200 sq. ft. climate controlled storage building and proposed parking area APPLICANT / PRESENTATION: Mr. Richard DeSchamps from Advanced Surveyors presented the site plan and held discussion on associated activities to construction of the building and parking area. TOWN STAFF / WEO: Mr. Weber reviewed the plans and indicated there is no negative impact to the surrounding wetland areas as a result of application activities and recommends approval. It was noted the plans indicated proper erosion and sediment control measures. MOTION made by Mr. Bienvenue, SECONDED BY Mr. Mr. Smith, That the Inland Wetland and Watercourses Commission approves Application #10-04 J.D. Thakral & Associates for construction of a storage building and proposed parking area as presented VOICE VOTE: UNANIMOUS; MOTION CARRIES 9. Correspondence: a. PROPOSED IWWW REGULATIONS: IWWC received correspondence from the State of CT, Department of Environmental Protection, Steven F. Tessitore, Supervising Environmental Analyst, Inland Water Resources Division; DATED: June 23, 2010; REGARDING: receipt of proposed Inland Wetlands & Watercourses Regulation amendments received June 3, 2011 from the Town of Franklin. b. MOHEGAN GOLF LLC/ ROADWORK: IWWC received correspondence from Attorney Ochsner regarding Mohegan Golf LLC easement agreements associated to roadwork that will be conducted as part of the golf course project. It is estimated five 5 easements will be required. Two easements are for drainage and 3 or 4 will be required for road construction purposes. 10. Report of the Chair: no further comments 11.
